DITA Limited Warranty
What Does This Warranty Cover?
This limited warranty covers any defects in material or workmanship in the new DITA eyewear product accompanied by this booklet. It doesn’t cover certain things, so please read it carefully.
This limited warranty extends only to the original consumer purchaser (after this, “you” or “your”) and can’t be assigned or transferred to anyone else. If you purchased this product from DITA, Inc. or DITA Eyewear Europe, Ltd. (after this, "DITA," “us,” “we,” or “our”), from a DITA Flagship Store, or from an authorized DITA retailer, you may obtain coverage under this limited warranty. If you purchased DITA product somewhere else, this limited warranty doesn’t apply.
What Does This Warranty Not Cover?
This limited warranty doesn’t cover any problem caused by (i) commercial use, (ii) normal wear and tear, or (iii) misuse, accident (including but not limited to collision, fire, and spilled food or liquid), neglect, abuse, alteration, unusual stress, modification, improper or unauthorized repair, or improper storage. This limited warranty is void if a product is returned with removed, damaged or tampered labels or markings, or any alterations. DITA DOES NOT WARRANT AGAINST ANY SCRATCHED, FRACTURED, OR SHATTERED LENSES. In addition, DITA does not provide any warranty for prescription lenses except those purchased from a DITA Flagship Store. Also, consequential, indirect, and incidental damages are not recoverable under this warranty.
How Long Does The Coverage Last?
The warranty period is one (1) year from the documented date of purchase, except that if you reside in the European Economic Area (EEA) and you purchased your DITA product in the EEA, the warranty period is two (2) years from the documented date of your purchase.
What Do You Have to do?
DITA will provide warranty coverage if your warranty claim complies with all terms of this limited warranty and you follow the return procedure that applies to you. If you don’t follow the applicable return procedure, you can’t obtain warranty coverage.
Prescription Lenses
For all prescription warranty claims, please contact the DITA Flagship Store from which your purchase was made. If you purchased prescription DITA eyewear product elsewhere, contact that retailer directly as DITA does not provide warranty coverage for these lenses.
All Other Claims
To obtain warranty service, we suggest that you first contact the DITA Flagship Store or authorized DITA retailer from which you purchased your DITA eyewear product, as they can typically provide expeditious warranty service for most minor issues.
To obtain warranty service directly from DITA, please call or email DITA to obtain a Return Material Authorization ("RMA") and return the defective product together with a copy of your dated proof of purchase to the address specified by DITA in connection with the RMA. You’ll need to pay the cost of shipping the product to DITA. If your claim is covered by this limited warranty, DITA will pay the cost of shipping the product back to you after the warranty service is completed.
Any product returned to DITA without a valid warranty claim, without an RMA or without proof of purchase may be rejected, returned to you at your cost or kept for a period of 30 days for your pick-up and then disposed of in DITA’s sole discretion after notifying you by phone or email that it intends to do so and giving you a final opportunity to make arrangements for return shipping. By sending a product for warranty service or replacement, you agree to transfer ownership of the original product to DITA at our warehouse if DITA determines that replacement is appropriate.
What Will DITA Do?
If DITA authorizes you to return your product to DITA, DITA will decide whether to repair or replace the defective product. If your product will be replaced, DITA will decide whether to replace it with a new or remanufactured product. If DITA, in its sole discretion, determines it’s not reasonable to replace the defective product, DITA may refund you the purchase price you paid for the product. Repaired or replaced products are covered for the remainder of the original product warranty or 90 days, whichever is greater.
What About Other Repairs?
If your DITA eyewear product doesn’t qualify for warranty service under this limited warranty or you can’t provide proof of purchase, you may still send in your DITA product for repair, but charges may apply. Please call or email DITA to learn more.
Which Laws Apply?
For purchases in the United States, this limited warranty is provided by Dita, Inc. and is governed by the laws of the State of California. For purchases made outside the United States, this limited warranty is provided by Dita Eyewear Europe, Limited and is governed by the laws of the Republic of Ireland.
This limited warranty gives you specific legal rights, and you may also have other rights that vary from jurisdiction to jurisdiction. This limited warranty does not affect any additional rights you have under laws in your jurisdiction governing the sale of consumer goods, including, without limitation, national laws implementing EC Directive 99/44 Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the limitations or exclusions in this limited warranty statement may not apply to you.
